	<dc:description xml:lang="en-US">Through an analysis of Law No. 19 of 2019 concerning the Eradication of Criminal Acts of Corruption, this paper analyzes the paradigm adopted by the Indonesian government when formulating strategies to combat corruption. Since their inception in 1957, laws and regulations on combating corruption have changed to reflect the evolution of the problem, the causes of corruption's growth in Indonesia, the dynamics of politics and the economy, and other aspects. The formation of Indonesia's Corruption Eradication Commission (KPK) in 2003, which performs a number of tasks, was a turning point in the country's efforts to eradicate corruption. With the publication of Law No. 19 of 2019, which replaces Law No. 30 of 2002 with the eradication of criminal acts of corruption, reform was also continued. This writing aims to analyze and measure the paradigm used by the Indonesian government in making policies to eradicate corruption through the analysis of Law no. 19 of 2019. The author uses the content analysis method in analyzing the law. Analysis was carried out on three indicators; actors, authorities, and governance which represent the three paradigms; realism (state), liberalism (non-state), and constructivism (social construction). Based on the results of the analysis, it can be concluded that; Law No. 19 of 2019 is strongly influenced by the realism paradigm, and although the law is appropriate to replace the previous law, the law still has several weaknesses to be corrected and revised by the government.</dc:description>

	<dc:description xml:lang="en-US">The Mandalika circuit project is a development project for international standard sports facilities and of course is also supported by the various advantages that Lombok, West Nusa Tenggara has. In fact, for the first time after the Mandalika project was built, it will be used in world level competitions, namely Superbike (WSBK), Grand Prix (MotoGP). The development of the project has of course attracted attention both nationally and internationally, so it is not surprising that it will attract investors to invest their capital in Indonesia, especially for the Mandalika Circuit Development Project, Lombok. So that these investment activities will have impacts for and on Indonesia and the surrounding population. So, through this article, the author seeks to find out what impacts are caused and then elaborates on the views of Prof. Dr. Mochtar Kusumaatmadja's concept of development law. This writing uses a normative juridical approach which refers to statutory regulations, legal norms, and literature study. The concept of development law advocated by Prof. Mochtar is to make law (various investment regulations in the Mandalika project) a means/tool for societal renewal (change). Through the application of rules or regulations (law as a tool of social engineering) for continuity of activity direction the desired community in development. The role of law in the development of the Mandalika project is expected to ensure that these changes take place in an orderly manner with the aim of achieving order which is one of the classic functions of law.</dc:description>

	<dc:description xml:lang="en-US">The dynamics of the presidential term in Indonesia have lasted since the Old Order, New Order, to the Reform Era. The regulations regarding the term of service of the head of state in this country have been changed several times and often invite pros and cons, as if they are never satisfied with being used as a topic of discussion about politics and power. The constitution that regulates this issue has even been amended. The idea of amending regulations related to limiting the presidential term of office has re-emerged at any time, especially in the midst of the heated political situation ahead of the general election. To examine the presidential term, a broader perspective is needed. The transcendental paradigm regarding restrictions on the head of state in Indonesia can not only be seen from a legal perspective, but also through ethical, moral and religious values. As a country with a majority Muslim population, the position of president can be reviewed under Islamic law. Maslahah Mursalah as a method of ijtihad can be used as a tool to analyze whether restrictions on presidential office are in line with the principles of benefit and preventing harm. This research uses the library research method, by analyzing positive legal regulations, Islamic law, as well as scientific literature related to this issue. The conclusion obtained from the writing is that limiting the presidential term of office is necessary and fulfills the requirements of the maslahah mursalah. This is because limiting the term of office of the head of state is a new problem that is not explained qathi in the two main sources of Islamic law, the Qur'an and the hadith, is enforced on the basis of values of the public interest, not individuals or groups, and contains the values of benefit and prevent harm.</dc:description>

With the existence of independent commissioners, all interested parties benefit greatly, especially through the establishment of conditions in accordance with the principles of Good Corporate Governance, where independent commissioners can provide opinions with a higher level of independence and accountability.</dc:description>

	<dc:description xml:lang="en-US">This research discusses Wedding in Bojonegoro in Al-‘Urf and Al-Maslahah Al-Mursalah (Phenomenological Study of Walimah Al-‘Urs Community in Pohwates Village, Kepohbaru District, Bojonegoro Regency). The purpose of this research is to answer the formulation of the problem: 1). How is the obligation to carry out walimah al-‘urs in the community of Pohwates Village, Kepohbaru District, Bojonegoro Regency?; 2). How is the strategy of implementing walimah al-‘urs (wedding) in the community of Pohwates Village, Kepohbaru District, Bojonegoro Regency?; 3). How is the impact of walimah al-‘urs on the wedding of the people of Pohwates Village, Kepohbaru District, Bojonegoro Regency? This research is a field research with qualitative methods. Data collection and research methods through direct interviews with respondents at the place of observation. All research data is collected and studied then analyzed descriptively analytically with a deductive mindset. The results of this study state that the practice of walimah al-‘urs which must be carried out by the people of Pohwates Village with luxury and festivity costs a lot of money, the minimum nominal that must be spent is IDR 41,000,000. The strategy taken to ease the burden of sahib al-hajah is in the form of arisan, buwuhan as debt, the implementation of walimah al-‘urs at harvest time, seserahan (Offerings given by the groom to the bride) with large and plentiful amounts. Walimah al-‘urs has a positive impact on the local community, namely, adding value to the sacredness and solidity of the household to maintain and preserve culture, strategies that appear to help, entertain, give a good name. While the negative impacts are the reduction in the practice of walimah al-‘urs in accordance with Islamic guidance, wasteful, delaying marriage continuously so that it can reduce productivity, increasing the risk of disorders in children, decreasing youth interest in marriage and the burden caused by debt and arisan.</dc:description>

To compare and contrast the two, this research integrates the idea of the rule of law from general theory with the understanding of Islamic law. This research emphasizes the state’s initiative to incorporate the ideas of Islamic law into its legal framework. While the idea of the rule of law and the principles of Islamic law are relevant, combining the two presents both opportunities and obstacles. This research is innovative in how it blends these ideas in Indonesia’s diverse environment. The findings from this research can help create an inclusive and just rule of law.</dc:description>

The purpose of this study was to analyze forest destruction on Sumbawa Island, West Nusa Tenggara Province from the perspective of Ecological Justice, by conducting an analysis of forest management policies on Sumbawa Island. The results of this study indicate that there has been massive forest destruction, for this reason the application of the concept of ecological justice in forest management on Sumbawa Island still needs to be implemented massively. This departs from the fact that massive forest destruction (natural exploitation) and/or environmental damage continues to occur, but an effective settlement of environmental cases has not yet been found. Likewise with the forest utilization policy on Sumbawa Island which still really needs a concrete role from the government and also the regional government of NTB . For the sake of realizing ecological justice, it cannot be separated from the role of the government as an institution authorized to implement laws and regulations. As the government as the guardian and/or executor of the law on the protection and management of the environment provides a sense of fairness in managing the environment.

	<dc:description xml:lang="en-US">Democracy as a government by the people in which the supreme power is vested in the people and exercised directly by them or their elected representatives under a system of free elections. In general, democracy is often interpreted as a government by the people, for the people and of the people. The supreme power in a democratic system is in the hands of the people. Elections as a manifestation of a democratic state of law that provides space for competitive and periodic (sequential) elite circulation. Elections with integrity are determined by 3 prerequisites, namely (1) the integrity of the election organizers, (2) the integrity of the contestation (stages), and (3) the integrity of the election results. The implementation of elections with integrity is a will based on a noble concern (ultimate concern) for the achievement of quality and integrity elections as a manifestation of a democratic legal state. In addition to realizing a fair election (electoral justice) which encourages the holding of elections based on the principles of direct, free general, secret, honest and fair / luber jurdil (free and fair election), legal certainty (predictable procedure), election results according to voter choice (electoral integrity).</dc:description>

	<dc:description xml:lang="en-US">The progress of the financial industry marked by the emergence of crypto assets at the global level is a result of the development of technological advances, through Regulation No. 99 of 2018 concerning the General Policy for the Implementation of Crypto Asset Trading and followed up with regulation of the Commodity Futures Trading Supervisory Agency No. 8/2021 making crypto assets recognized as commodities, meaning that crypto assets in Indonesia are only recognized as commodity assets not as means of payment, related to the development plan of crypto asset exchanges in Indonesia, the need for legal updates related to regulations, human resources and governance. Besides, given its fluctuating nature and tending to give discontent, its use as a transaction is forbidden in Islam, but is lawful as long as it is used as a commodity asset with clear underlying assets and fulfills the sil’ah.This type of research is normative juridical and is analyzed using qualitative data analysis, using legal comparisons from countries that already have crypto asset regulation first, then the Singapore state deserves to be used as a parameter to conceptualize legal updates in Indonesia in the governance and regulation of crypto assets in Indonesia.

	<dc:description xml:lang="en-US">Nowadays, crypto assets are increasingly showing their existence, not only as digital assets but can also be used as dowries in marriage. However, the use of crypto assets as dowry does not yet have a legal basis in the Marriage Law or its amendments. Instead, it is determined that the validity of marriage is returned to the religious law of each prospective bride and groom. The focus of the purpose of this research is to analyze the law of crypto assets as a dowry in marriage from the perspective of Islamic law in Indonesia. This research is a type of normative legal research using the statute approach method. The legal materials used are primary and secondary legal materials. Data collection techniques are carried out through literature studies by tracing, collecting, researching, and reviewing or analyzing legal materials. The data obtained is then analyzed using qualitative analysis. The results show that the provisions regarding dowry in marriage according to Islamic Law are specifically regulated in the Compilation of Islamic Law, but there are no provisions regarding the conditions under which something can be used as dowry. In the legal context, crypto assets as a dowry in marriage according to Islamic law in Indonesia, based on the conditions of dowry outlined by Shaykh Abdurrahman Al-Juzairi, are invalid because crypto assets do not meet some of the requirements of dowry, namely valuable property, holy and halal goods, and known types and characteristics.</dc:description>

	<dc:description xml:lang="en-US">The concepts of positivism and utilitarian schools show differences in regulating or interpreting society and individual rights. The purpose of this research is to find the views of the pure law school and the utilitarian law school in reconstructing indigenous peoples. This research uses normative legal research. In its study, this research uses several approaches, namely the statutory approach and the concept approach. The results showed that John Austin's pure legal school places the construction of indigenous peoples in the standard norms contained in Article 18 B paragraph (2) of the 1945 Constitution. This flow limits the interpretation of the construction of indigenous peoples. Meanwhile, according to the utilitarian legal school of Jeremy Bentham, the view of Article 18 B paragraph (2) of the 1945 Constitution as the basis for the construction of indigenous peoples shifts by interpreting the existence of indigenous peoples is not only seen as law an sich, but the legal regulation of legal communities is seen in 3 (three) aspects, namely a) indigenous peoples are seen in the position of legal reality; b) Customary law becomes a translation of the legal provisions referred to in Article 18 B paragraph (2) of the 1945 Constitution; c) Recognition and protection of the law of indigenous peoples are constructed in the aspect of legal reality. Thus, the utilitarian school of law opens a new approach in the construction of indigenous peoples that is not only reviewed from the norms an sich in statutory regulations but the existence of utilitarian schools of law can be used to open more lively legal spaces in constructing recognition and protection of the rights of indigenous peoples as subjects of law.</dc:description>

The research method is normative juridical research with a qualitative analysis approach using primary and secondary legal sources . As a conclusion that the need for equal participation for women and men to exercise their rights and obligations in every policy and program as well as legal norms in laws and regulations that can guarantee equality of policies and programs that provide benefits to men and women.</dc:description>

	<dc:description xml:lang="en-US">Kebo Balik Kandang marriage is said to be a mythical procession in the community where the bride is prohibited from marrying a man who lives in the same region as her biological father. This means that even though the bride comes from a village outside the region, if there is a track record of the bride’s village-born origin categorized as a Kebo Balik Kandang marriage type design, mythically it has a significant influence on the pattern of her family’s resilience. Family resilience means managing physical and non-physical resources and facing problems with the aim of achieving a quality family as a foundation in maintaining national resilience. Research in Bendo Village aims to examine the community’s views on kebo balik kandang marriages and how they maintain household resilience. The results show that the perpetrators of kebo balik kandang marriages face many challenges in their marriage journey. However, there is one family who managed to live a good marriage through mutual submission, love, care, good communication, and pleasant interaction. According to Islamic studies, their marriage is in accordance with sharia and there are no prohibited blood ties.</dc:description>

	<dc:description xml:lang="en-US">Critical land within forest areas in Indonesia is expanding. This has an impact on natural disasters and climate change. This condition is a serious concern of the international world so that almost every international meeting on critical land issues and climate change is the main topic discussed by offering a variety of critical land management schemes but is considered ineffective. Behind the legal policy of handling critical land that is considered ineffective, there is long-standing traditional knowledge carried out by the people of Sumbawa, namely lar, which maintains a balance between ecology, social, economic and spiritual. The purpose of this research is to analyze the determination of Lar’s land rights on critical land in forest areas as a strategy for sustainable forest management. This research method is normative research with a conceptual approach, legislative approach and sociological approach. The results of this study, first, the concept of lar has three forms of land rights status, namely customary rights, rights, state-owned land and privately owned land so that state-owned land in the form of forest areas whose conditions are critical can be assigned lar land rights. Second, the concept of handling critical land in the area must be based on a balance between ecology, economy, social and spiritual. Third, the establishment of lar land rights in the forest area does not have to change the main function of the forest area.  The conclusion of this research is that the establishment of lar land rights on critical land in forest areas can be carried out based on the balance between ecology, economy, social and spiritual without changing the function of the forest</dc:description>

	<dc:description xml:lang="en-US">The settlement of criminal cases is the authority of law enforcement, in this case the police, prosecutors, and courts. In criminal law, penal mediation or diversion is also known, but the mediator is usually a law enforcement officer and is completed in law enforcement institutions, not in certain communities such as the West Nusa Tenggara Bale Mediasi. The research method used in this research is normative research with a statute approach and conceptual approach. The results of the research found that Bale Mediasi has the authority to resolve criminal cases as long as it does not conflict with statutory regulations, based on the spirit of restorative justice and diversion in Law Number 11/2012, local values, and handling cases through consensus procedures. So that an agreement between the parties is reached as referred to in Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution. The deed of peace in criminal cases produced through the mediation process at Bale Mediasi is final and binding. To strengthen the peace deed, it can be registered with the court to obtain executorial power. If no peace agreement is reached between the parties, the dispute settlement continues in accordance with applicable legal procedures in a professional and proportional manner. It is suggested that it needs to be clarified in regional regulation number 9 of 2019 concerning Bale Mediasi related to the type of religious civil disputes that can also be obtained to the religious court to obtain executorial power. In addition, it is necessary to hasten the signing of a memorandum of understanding between the Governor and the Head of the Regional Police, the High Prosecutor and the President of the High Court as the basis for the executorial deed of peace.</dc:description>

	<dc:description xml:lang="en-US">In Islam, adopting children has been known since the time of the Prophet Muhammad. Literally, tabbani means a family couple who tries to get a foster child from another family, then treats it as if it were their biological child. The reality of informants in Sawentar, Blitar, child adoption is based on the agreement of biological parents with adoptive parents, then the adopted child is manipulated as if he were the biological child of the adoptive parents, without going through the court process, Research qualitative approach type of observational research, field-research, determination of empirical approaches, subjected to 3 primary sources. Descriptive qualitative means using qualitative data, then described descriptively. Problems are solved by non-doctrinal empirical normative studies, sourced from primary and secondary data. The purpose of the research is to describe the process of adoption without trial, under HI / Islamic Law and or HP / Positive Law. Documentation, data collection by interviewing, observing reinforced the technique of analyzing documents in the design of descriptive qualitative methods, starting with reducing, presenting, ending with drawing conclusions, where the researcher holds the primary key. The conclusion was found that child adoption in Sawentar Village, the subject of the study carried out the adoption without going through the procedures as established by the government. This means that in positive law there is a violation of the law. The subject considers the judicial procedure to be a lot of time consuming, feels the complexity, does not meet the requirements of adoption, and the lack of understanding regarding child adoption according to the law. Implications, reviewing positive law, judicial child adoption is not fulfilled, if the socialization of adoption in the community is not intensified. Adoption is more about the agreement of both parties without a court process. Then, there is a lack of legal protection for adopted children, confidentiality in both, if not open, nasab (family ties based on blood relations, both up, down, and sideways) and the pleasure of the mother, father or biological person will be lost.</dc:description>

	<dc:description xml:lang="en-US">An ethics-based information security system based on Immanuel Kant's transcendental legal paradigm can give a strong foundation for tackling moral quandaries in AI, hacking, and information systems. Lavanya Singh highlights the necessity of instinctive ethics based on philosophical literature and presents a Kantian ethics application that adheres to the philosophical tradition. Meanwhile, Sanchita Saha et al. address ethical hacking as a method of disclosing vulnerabilities in information systems for the benefit of society, emphasizing ethical concerns in cybersecurity operations. Furthermore, Flávia Maria Santoro and Rosa Maria Esteves Moreira da Costa underline the significance of examining information systems via an ethical lens in order to negotiate conceptual conflicts and make informed judgments in delicate situations, which is consistent with Kant's moral philosophy. Using doctrinal research methodologies with legal material sources derived from literature studies and qualitative descriptive analysis. This study discovered that by incorporating Kant's concepts into information security systems, the transcendental legal paradigm may guide ethical decision making and promote responsible technological advancement. The Ethics-Based Information Security Systems Act, modeled after Immanuel Kant's Transcendental Paradigm, would prioritize universal ethical principles, respect for human autonomy, duty-bound behaviors, transparency, accountability, and a structured regulatory framework. The law will guarantee that information security is maintained not just through technological means, but also via a solid ethical foundation that respects the dignity and rights of all those concerned.</dc:description>

	<dc:title xml:lang="en-US">The Legality Principle's Expansion in the National Criminal Code as a Manifestation of the Idea of Balance (Tawazun)</dc:title>

	<dc:description xml:lang="en-US">This paper aims to analyze the concept and justification of the legality principle’s expansion in the Indonesian National Criminal Code and how its expansion is a manifestation of the idea of balance in the Indonesian criminal law’s renewal. This paper employed doctrinal legal research, i.e., a process to find legal regulations, principles, as well as doctrines to answer the legal issues being faced. Based on the research results, the formulation of the legality principle (formal) in the Criminal Code (WvS) was developed based on the certainty principle which is difficult to adapt with the development of the living law in society. Therefore, the National Criminal Code expands the meaning of the legality principle from having formal characteristics into a legality principle with material characteristics. It is specifically formulated in Article 2 clause (1) of Law No. 1 of 2023 on the National Criminal Code. According to this regulation, the legal source which states that an action is categorized as a criminal action based on the formal legality principle (based on the law as referred to in Article 1 clause (1)) does not decrease the application of the living law in society which determines that a person can be penalized even though his actions are not regulated in legal regulations. The insertion of the material legality principle in the National Criminal Code has the objective that the living law is also acknowledged as a legal source. The formulation of the material legality principle aims to protect the standard of values and norms that live in society to fulfill a sense of substantial justice. This is to create a balance between “legal certainty” and “justice”.
 
Tujuan dari penelitian ini yaitu untuk menganalisis bagaimana konsep dan justifikasi perluasan asas legalitas dalam KUHP Nasional dan bagaimana perluasan asas legalitas sebagai wujud ide keseimbangan dalam pembaharuan hukum pidana Indonesia. Penelitian ini menggunakan penelitian hukum doktrinal, yaitu suatu proses untuk menemukan suatu aturan, prinsip, maupun doktrin-doktrin hukum guna menjawab isu hukum yang dihadapi. Berdasarkan hasil penelitian, formulasi asas legalitas (formil) dalam KUHP (WvS) dibangun di atas pondasi kepastian yang sulit beradaptasi dengan perkembangan hukum yang hidup di masyarakat. Oleh karena itu, KUHP Nasional memperluas makna asas legalitas dari yang sifatnya formil ke dalam asas legalitas yang sifatnya materil, tepatnya yaitu dirumuskan pada Pasal 2 ayat (1) KUHP Nasional. Menurut Pasal 2 ayat (1) KUHP Nasional, sumber hukum untuk menyatakan suatu perbuatan sebagai tindak pidana yang didasarkan pada asas legalitas formil (berdasarkan undang-undang sebagaimana dimaksud Pasal 1 ayat (1)) tidak mengurangi berlakunya hukum yang hidup dalam masyarakat yang menentukan bahwa seseorang patut dipidana walaupun perbuatan tersebut tidak diatur dalam undang-undang. Dimasukkannya asas legalitas materiel ke dalam KUHP Nasional bertujuan agar hukum yang hidup (the living law) juga diakui sebagai sumber hukum. Formulasi asas legalitas materiel bertujuan untuk melindungi standar nilai dan norma yang hidup di masyarakat demi memenuhi rasa keadilan yang substantif, sehingga akan terjalin keseimbangan antara “kepastian hukum” dan “keadilan”.</dc:description>

	<dc:description xml:lang="en-US">Qiyas is one of the methods of ruling in Islam that is used to determine the rulings of contemporary cases that do not have a direct text from the Qur'an and Sunnah. There are many contemporary cases that require a qiyas approach in determining the law. Therefore, this research is important to do in order to fill the void. This research is a descriptive qualitative research with a literature study approach. This approach is used to analyze the application of qiyas in contemporary muamalat based on the opinions of classical and contemporary scholars, as well as studies from fatwas of sharia institutions. This data is taken from various sources of literature relevant to the topic of qiyas, such as books of ushul fiqh, the views of fuqaha, and fatwas issued by sharia institutions, such as AAOIFI and Majma' Fiqh Islami. The stages of research are the stages of collecting literature data (library research), data validation, through triangulation. The next stage of data analysis and interpretations and the preparation of conclusions by systematically examining the application of qiyas in contemporary muamalat is carried out using qualitative descriptive analysis methods. The result of the study is that qiyas is defined as the similarity of the branch to the origin in terms of legal illat. The urgency of qiyas in contemporary muamalat law is crucial, especially due to the limitations of nash and ijma. Qiyas plays an important role in providing sharia legal certainty for various cases that continue to develop. The views of classical and contemporary scholars on the importance of qiyas in determining Islamic law, as well as several related fatwas issued by world fatwa institutions, are the basis for determining (istinbath) the law. With qiyas, Islamic law remains relevant to be applied in modern economic transactions. The application of qiyas in various contexts of contemporary muamalat, such as the qiyas of currency with dinars and dirhams, the validity of cash waqf with qiyas against weapons of war, as well as the validity of service lease transactions and qiyas on salam contracts. The application of qiyas leads to the determination of certain laws and leads to legal certainty regarding the contemporary issue in question.</dc:description>

	<dc:description xml:lang="en-US">Regional Head Elections in Indonesia are often colored with religious polarization, which becomes a challenge for democracy and may potentially trigger conflicts. The Election Supervisory Agency holds a crucial role in mitigating this polarization. This research aims to analyze the Election Supervisory Agency’s political mitigation model against religious polarization in Regional Head Elections. Using the qualitative approach with the doctrinal method, this research analyzed legal regulations and democratic principles related to the general election as well as analyze the Election Supervisory Agency’s role in handling religious polarization.
Research results showed that religious polarization in Regional Head Elections is manifested in several forms, such as using issues related to ethnic groups, religion, race, and groups in campaigns, spreading religion-related hoaxes and hate speech, as well as mass mobilization based on religious sentiments. Even though the Election Supervisory Agency has a supervisory mandate, it faces limitations in handling religious polarization. This issue is often under the scope of political ethics, which is not specifically regulated in the General Election Law. The analysis also shows that democratic and religious principles, especially those of Islam, support deliberation and dialogs, which may become a base for mitigating polarization.
This research concludes that the Election Supervisory Agency needs to develop a more comprehensive political mitigation strategy which involves cooperation with various parties and strengthens the public understanding of political and democratic ethics. This research recommends the expansion of the Election Supervisory Agency's authority in handling violations against political ethics, strengthening coordination with other institutions, and increasing society's political literacy.

	<dc:description xml:lang="en-US">The issue of justice in society is still a matter of debate among academics, working practitioners and ordinary people. The objectives of this research include (1) To explain the concept of justice in the views of Aristotle and Imam Asy Syatibi; (2) To conduct a comparative analysis between Aristotle's and Imam Asy Syatibi's concepts of justice. The research method used is qualitative research using a philosophical and comparative approach. The results of this research explain that Aristotle's view of justice is a grant of equal rights but not equality. Aristotle differentiates equal rights from proportional rights. In his view, Aristotle divided it into three types, namely, commutative, distributive and corrective justice. Meanwhile, in Imam Asy-Syatibi's view, the concept of justice is part of the maqashid sharia framework, which is the goal of religion to create benefits for all mankind. Ash-Syatibi conceptualizes justice in the Kulliyat al-Khamsah principle with the following priorities: maintenance of religion, soul, lineage, reason, and property which are summarized in three levels, namely dharuriyyat, Hajiyyat, and Tahsinniyat, Aristotle and Imam Asy-Syatibi have similarities and differences which is pretty basic. The similarity of the concept of justice in Aristotle and Imam Asy-Syatibi lies in the desire that justice can lead to the welfare of society and create a civilized, moral personality in society. Meanwhile, the difference between Aristotle's and Imam Asy-Syatibi's concepts of justice lies in the philosophical approach, justice criteria and final goals.</dc:description>

	<dc:description xml:lang="en-US">Copyright certificates for songs can be an object of fiduciary collateral in baking making it easier for creative economy actors to obtain credit. The problem of this research is what are the legal aspects of using copyright certificates as fiduciary collateral in credit agreements and what is the legal protection of banking financial institutions against the execution process. The aim and benefit of this research is to determine the legal aspects of using copyright certificates as fiduciary collateral in credit agreements and the protection of banking financial legal institutions against the execution process. This research method uses normative juridical research which uses a legal and conceptualization approach with data collection methods from literature studies and interviews. Based on research results, banking financial institutions have not accepted copyright certificates as objects of fiduciary collateral because they did not receive socialization from the central bank and weakened copytight market segmentation, making it difficult for the execution process when debtors default. Therefore, the use of copyright certificates in banking refers to the Fiduciary Guarantee Law, Copyright Law, Creative Economy Law and Creative Economy PP and the existence of legal protection, both preventive, namely in collaboration with LMKN and repressive through litigation and non-litigation against banks, is expected to be able to reduce risk and make it easier for banks to carry out the executions process when debtors default.</dc:description>

	<dc:description xml:lang="en-US">Urgensi penelitrian ini adalah mengingat bahwa negara Indonesia Masyarakat yang pluralistic, baik suku maupun agamanya. Pluralistik  agama bisa dilihat dari agama yang diakui negara terdapat 5 yaitu agama Islam, katholik, Kristen, Hindu, Budha dan Kong huchu. Setiap agama selalu meyakini bahwa agamanya yang paling benar. Klaim kebenaran juga dimiliki agama Islam. selain klaim kebenaran, Islam memiliki Sejarah tersendiri dibandingi agama lainnya. Tidak bisa dipungkiri bahwa muslim memiliki andil besar dalam kemerdekaan Indonesia. Sehingga tidak heran Sebagian umat Islam menginginkan Indonesia menjadi negara islam (Islamic state). Fenomena di atas tentu bisa menjadi ancaman bagi persatuan bangsa Indonesia. Padahal negara Indonesia yang berasaskan Pancasila telah mengakomodasi kepentingan semua agama. Khususnya agama Islam yang telah mengakomodasi tujuan syari’ah. Sehingga harapannya dengan konsep negara hukum pencasila berbasis maqasidu shari’ah bisa meredamkan keinginan untuk mendirikan negara islam. Tujuan Penelitian ini adalah : 1) Bagaimana konsep negara hukum Pnacasila berbasis maqasidu shari’ah, 2) bagaimana moderasi beragama dalam konsep negara hukum Pancasila berbasis maqasidu Shari’ah. Metode  penelitian ini  kepustakaan dengan pendekatan kualitatif. Metode penelitian yang digunakan pada penelitian ini adalah analisis isi. Analisi isi merupakan suatu studi yang menggabungkan hasil banyak studi orisinal, sistematis, dan terencana. Metode ini dilaksanakan melalui lima tahap, yaitu (1) Pengumpulan data; (2) Pertanyaan penelitian; (3) Hipotesis yang akan diuji; (4) Penyajian data dan (5) Penarikan kesimpulan. Sumber data dalam artikel ini adalah jurnal dan buku. Luaran yang ditargetkan dalam penelitian ini adalah publikasi hasil penelitian pada jurnal internasional bereputasi yang terindek Scopus.
Indonesia is a pluralistic state with various ethnic groups and religions. Even so, it cannot be denied that Muslims have a great role in claiming Indonesian independence. Thus, it is no wonder that part of the Muslim community wishes Indonesia to become an Islamic state, even though it is based on Pancasila, which accommodates the interests of all religions. This condition certainly becomes a threat to the unity of the Indonesian nation. The Pancasila legal state concept based on maqasid sharia is hoped to dampen the desire to establish an Islamic state. This research aims to: (1) analyze the Pancasila legal state concept based on maqasid sharia, and (2) analyze religious moderation in the Pancasila legal state concept, based on maqasid sharia. This was library research which employed the qualitative approach. The research method used in this study was the content analysis, which was a study which combines various original, systematic, and planned studies. Research results showed that religious moderation in Indonesian diversity is crucial. One of the reasons is that Indonesia is a plural country both in terms of ethnic groups and religions. A religious understanding that is exclusive may be directed to religious moderation. A radical religious thought regards Pancasila as violating Islamic teachings. This paper shows that the Pancasila legal state concept is according to maqasid sharia as it accommodates the protection of religion, the protection of lives, the protection of offspring, the protection of the mind, and the protection of wealth.</dc:description>

	<dc:description xml:lang="en-US">The waqf pledge deed is a crucial legal document in Islamic law that provides the dedication of property to religious, charitable, or community purposes. This study used the systematic literature review (SLR) approach to gather, evaluate, and synthesize pertinent information about the evidential power of the waqf pledge deed as proof of land ownership. The empirical data is then evaluated using a normative legal method that includes both a statutory (statue approach) and a conceptual (conceptual approach).The study's findings indicate that research on waqf is expanding, with an emphasis on Islamic financial innovation, socioeconomic benefits, and digital technology integration. Cash waqf in Indonesia is critical to the development of the Islamic economy. To boost the effectiveness of waqf management, researchers are looking into integrating Islamic charitable tools with digitalization institutions. This expansion highlights the significance of waqf in economic empowerment and social development, with opportunities for further research in digital innovation and policy.</dc:description>

	<dc:description xml:lang="en-US">Lingkungan hidup adalah suatu sistem yang saling terikat dan harus dijaga keseimbangannya, baik dari perspektif ekologi maupun ajaran Islam. Dalam pandangan Islamic Environmental Justice, keseimbangan (mizan) menjadi prinsip utama dalam pemanfaatan sumber daya alam untuk menghindari eksploitasi berlebihan yang dapat merusak ekosistem. Penelitian ini menyoroti pengelolaan sampah di Kota Palangka Raya, khususnya pelaksanaan kebijakan bank sampah dan efektivitas platform digital Info Bang Apul dalam meningkatkan kesadaran masyarakat terhadap pengelolaan sampah. Metode yang digunakan adalah pendekatan empiris dengan data kuantitatif, didukung oleh data kuesioner yang diperoleh dari 136 responden. Hasil penelitian mengungkapkan bahwa meskipun telah terdapat aturan seperti Undang-Undang Nomor 18 Tahun 2008 tentang Pengelolaan Sampah dan Peraturan Walikota (Perwali) Kota Palangka Raya Nomor 20 Tahun 2019 tentang Kebijakan Pengelolaan Sampah, pelaksanaannya masih menghadapi berbagai kendala. Kendala utama adalah rendahnya pemahaman dan keterlibatan masyarakat dalam pengelolaan sampah. Jika ditinjau dari perspektif hukum lingkungan dan keadilan ekologis dalam Islam, kondisi tersebut mencerminkan bentuk ketidakadilan ekologis, di mana masyarakat belum mendapatkan akses yang merata terhadap solusi pengelolaan sampah yang berkelanjutan. Teknologi bank sampah digital seperti Info Bang Apul memiliki potensi dalam meningkatkan efektivitas pengelolaan sampah tetapi masih memerlukan sosialisasi lebih lanjut agar lebih dikenal dan digunakan secara luas oleh masyarakat. Selain itu, perlu adanya peningkatan fitur pada Info Bang Apul guna memberikan informasi lengkap dan menyediakan berbagai layanan untuk meningkatkan partisipasi masyarakat. Penelitian ini merekomendasikan strategi peningkatan pengetahuan masyarakat melalui edukasi serta optimalisasi peran pemerintah dengan sosialisasi. Dengan penerapan prinsip keadilan lingkungan Islam dan penggunaan teknologi digital, diharapkan pengelolaan sampah yang lebih berkelanjutan dapat tercapat di Kota Palangka Raya.
 
The environment is an interrelated system whose balance must be preserved both from the ecological and Islamic perspectives. From the perspective of Islamic Environmental Justice, balance (mizan) becomes the main principle in the usage of natural resources to prevent excessive exploitation that may damage the ecosystem. This research focuses on analyzing the waste management in Palangka Raya City, Central Kalimantan Province, Indonesia, especially in the implementation of the waste bank policy and the effectiveness of the Info Bang Apul digital platform in increasing society’s awareness of waste management. The method used in this research was the empirical approach with quantitative data, supported by data from questionnaires which were spread to 136 respondents. Results of this research showed that even though there are already regulations such as Law No. 18 of 2008 on Waste Management and the Regulation of the Palangka Raya City Mayor No. 20 of 2019 on the Waste Management Policy, their implementation still faces various obstacles. The main obstacle was society’s lack of understanding and involvement in waste management. If analyzed from the perspectives of environmental law and ecological justice in Islam, such a condition reflects a form of ecological injustice, where society still has not obtained equal access to the solution of sustainable waste management. Digital waste bank technologies such as Info Bang Apul have the potential to increase the effectiveness of waste management. However, there is still a need for further introduction so that society may know and widely use them. Apart from that, there needs to be an increase in Info Bang Apul’s features to provide more comprehensive information and add various services to increase community participation. This research recommends strategies to increase society’s knowledge through education as well as the optimization of the government’s role through program introduction. It is hoped that the application of the Islamic environmental justice principles and the usage of digital technologies may lead to the achievement of more sustainable waste management in Palangka Raya City, Indonesia.</dc:description>

	<dc:description xml:lang="en-US">This research aims to analyze the influence of oligarchy on democracy and social justice in Indonesia from Islamic perspective. This research employed the descriptive-qualitative approach using literary and case study methods. The data were obtained from various academic literary materials, journal articles, as well as analyses of concrete cases, such as oligarchic practices in the political, economic, and religious sectors. Research findings showed that oligarchy fundamentally violates the Islamic principles of justice, equality, deliberation (syura), and responsibility. Oligarchy has manipulated the political-economic system through the practice of expensive political financing, the use of the state’s resources, the use of descendants of the kiai’s lineage (Islamic religious figures) in political elections, the weakening of anti-corruption institutions (such as the Corruption Eradication Commission), as well as their domination in public positions. Cases such as the election of village heads and regents who are descendants of the kiai lineage, colored with the practice of power dynasty and natural resource exploitation by political elites, reflect the negative impacts of oligarchy’s dominance. To overcome this problem, there is a need for an integration of Islamic values into the democratic practices dominated by oligarchic groups, as well as an institutional reformation to achieve transparency and accountability. Even so, the success of reformation highly depends on the courage of political actors to free themselves from oligarchic pressures while prioritizing the people’s interests. Apart from that, the difficulty to integrate Islamic values happens due to public officials’ lack of Islamic political ethics. Therefore, building a democratic political and economic system based on the value of Islamic social justice becomes the absolute requirement for carrying out jihad against the oligarchic group.</dc:description>

	<dc:description xml:lang="en-US">Article 28H paragraph (4) of the 1945 Constitution of Indonesia guarantees citizens the right to private property, including land, which cannot be taken arbitrarily. This study aims to: (1) describe current land titling policies; and (2) explain the policy on registering customary land rights. The research uses a normative, qualitative doctrinal approach. In Islamic land law, land is considered the property of Allah SWT, with humans granted authority to manage it in accordance with sharia. Thus, land management should adhere to divine, not human, laws. Indonesia’s current land certification policy is based on the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency No. 12 of 2017, which governs the Acceleration of Complete Systematic Land Registration (PTSL). This program targets certification of 126 million land parcels by 2025. Land registration contributes to community welfare by offering legal certainty and protecting property rights. However, Government Regulation No. 27/1999 does not recognize customary (ulayat) land as eligible for certification, despite the constitutional mandate and the Basic Agrarian Law (UUPA) to protect such lands. To resolve this, the government can issue Customary Land Certificates through Regional Regulations as part of the Customary Land Registration process, ensuring legal recognition and protection of customary community land rights.</dc:description>

	<dc:description xml:lang="en-US">The issue of joint property agreements in marriage is an important issue in family law, especially when divorce occurs. In the context of Indonesia's positive law, the regulation of common property normatively refers to the Civil Code (KUHPercivil), especially Articles 119 to 128. However, in practice in indigenous peoples, especially Balinese people who adhere to Balinese Hindu Customary Law, the arrangement and understanding of common property has different values, norms, and structures, which are often not fully recognized in the national legal system. This normative gap raises conceptual issues regarding the recognition and legal protection of joint property agreements in two different legal systems. This research uses a normative legal approach, with legal sources coming from legislation, judges' decisions. Furthermore, legal materials are analyzed using interpretive descriptive and analytical descriptive. The results of the study show that the common property agreement must not only fulfill the elements of the validity of the agreement in a positive legal manner, but must also reflect the values of justice that live in society, especially transcendental justice, which is justice that comes from religious and spiritual values that are upheld in Balinese Hindu customs. So that the ideal formulation of the concept of a common property agreement is to integrate the normative elements of the Civil Code with Balinese Hindu customary law practices. The binding power of mutual price agreements in the context of juridical and transcendental justice, becomes a form of reconstruction of family law that recognizes the plurality of laws and places substantive and spiritual values of justice as the basis for binding agreements, without ignoring the principles of legality and formal legal validity</dc:description>

Politik hukum PSN menunjukkan dominasi paradigma antroposentris yang menempatkan hukum sebagai instrumen akselerasi ekonomi, alih-alih sebagai mekanisme perlindungan ekologis. Dengan menggunakan metode yuridis normatif dan analisis interpretatif-dekonstruktif, penelitian ini menelusuri ketegangan antara norma konstitusi ekologis dalam Pasal 28H dan 33 UUD 1945, kebijakan pembangunan, serta konfigurasi regulasi perizinan tambang. Temuan menunjukkan bahwa tafsir sempit terhadap konsep penguasaan negara telah menggeser orientasi hukum dari kemaslahatan ekologis menuju kepentingan kapitalistik. Melalui paradigma Keadilan Profetik, penelitian ini menawarkan rekonstruksi nilai hukum yang mengintegrasikan humanisasi, liberasi, dan transendensi dalam kebijakan perizinan. Rekomendasi mencakup penerapan green licensing, sustainability-based approval, dan community-based monitoring sebagai kerangka tata kelola perizinan tambang yang berkeadilan ekologis dan berlandaskan etika profetik.
This research analyzes and deconstructs the legal politics of the national strategic project (NSP) permit in the mining sector using the green constitution and prophetic justice approaches. The legal politics of NSP shows the domination of an anthropocentric paradigm, which places the law as an instrument of economic acceleration, rather than as a mechanism of ecological protection. Using a juridical normative method and an interpretative-deconstructive analysis, this research studies the tension between ecological constitution norms in Articles 28H and 33 of the 1945 Constitution, development policies, as well as the configuration of mining permit regulations. Findings show that a narrow interpretation of the state control concept has shifted the legal orientation from ecological benefit (maslahah) to capitalistic interests. Using the prophetic justice paradigm, this research offers a reconstruction of legal values that integrate humanization, liberation, and transcendence in a permit policy. Recommendations include the application of green licensing, sustainability-based approval, and community-based monitoring as a framework of mining permit governance, which is based on ecological justice and prophetic ethics.</dc:description>

Meningkatnya perkara sengketa hukum medis di Indonesia menunjukkan bahwa mekanisme penyelesaian melalui peradilan umum belum mampu memberikan putusan yang adil dan proporsional. Kerumitan interaksi antara norma hukum dan ilmu kedokteran sering menimbulkan hambatan dalam proses pembuktian, sehingga memunculkan ketidakseimbangan pemahaman antara aparat penegak hukum dan tenaga kesehatan. Kondisi tersebut berimplikasi pada munculnya ketidakpastian hukum bagi para pihak yang berperkara. Penelitian ini bertujuan mengidentifikasi kelemahan mendasar dalam sistem peradilan yang berlaku serta merumuskan desain peradilan ad hoc berbasis kompetensi sebagai alternatif penyelesaian sengketa medis. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual, memanfaatkan bahan hukum primer (UUD NRI 1945, UU Kekuasaan Kehakiman, dan regulasi bidang kesehatan) serta bahan hukum sekunder dari literatur dan putusan pengadilan. Temuan penelitian memperlihatkan bahwa peradilan umum tidak memiliki kapasitas teknis yang memadai untuk menangani kompleksitas perkara medis. Karena itu, dibutuhkan model peradilan ad hoc yang mengintegrasikan keahlian hukum dan medis secara berimbang. Pengembangan model ini diharapkan dapat mewujudkan keadilan substantif, meningkatkan efektivitas penyelesaian perkara, dan memperkuat kepastian hukum dalam penanganan sengketa medis di Indonesia.
The increasing number of medical legal disputes in Indonesia shows that the resolution mechanism through general justice methods cannot provide a just and proportional decision. The complicated interaction between legal norms and medical science often becomes an obstacle in the evidencing process, creating an imbalance of understanding between law enforcing apparatuses and health workers, creating legal uncertainty for the disputing parties. This research aims to identify the basic weakness in the applicable justice system as well as formulate a competence-based ad hoc justice design as an alternative to resolve medical disputes. This research employed the normative legal method with statute and conceptual approaches, utilizing primary legal materials (the Indonesian 1945 Constitution, the Law on Judicial Power, and regulations in the health sector) as well as secondary legal materials from literary materials, such as court decisions. Research findings show that general justice does not have adequate technical capacity to handle the complexity of medical cases. Therefore, there is a need for an ad hoc justice model which integrates medical and legal expertise in a balanced manner to create substantive justice, increase the effectiveness of the dispute resolution process, and strengthen legal certainty in handling medical disputes in Indonesia.</dc:description>

	<dc:description xml:lang="en-US">Customary law selam air is positioned as the final step in dispute resolution within the Dayak Kanayat'n Indigenous Community in Kersik Belantian Village, especially when the customary deliberation process is no longer able to produce an effective solution. This study formulates the main question of how the customary law of selam air is implemented in handling disputes within the Dayak Kanayat'n indigenous community. This study aims to examine in depth and describe the implementation of the selam air mechanism as a means of dispute resolution. The approach used is an empirical legal method with a legal anthropology perspective, while the data collected, both primary and secondary, is then processed and interpreted through qualitative analysis. The results of the study reveal that the customary law of selam air is implemented through traditional ceremonies and carried out by diving into water, where the party that can survive the longest in the water is declared the winner, reflecting the values of struggle, honesty, and sincerity in interpreting justice. This selam air customary mechanism is one manifestation of justice that is alive and believed in by the Dayak Kanayat'n Indigenous Community. The uniqueness of this research lies in the revelation of the selam air customary law as a final form of living law with transcendental values, which has not been widely studied academically, so it is hoped that it can contribute to the study of legal pluralism in Indonesia.</dc:description>

	<dc:description xml:lang="en-US">Penelitian ini menganalisis penerapan Economic Analysis of Law dalam menilai efisiensi regulasi Omnibus Law Cipta Kerja di Indonesia. Fokus kajian diarahkan pada bagaimana kebijakan deregulasi tersebut berpengaruh terhadap efisiensi ekonomi nasional, peningkatan investasi, serta keseimbangan antara pertumbuhan ekonomi dan keadilan sosial. Melalui pendekatan teori efisiensi hukum, Pareto Efficiency, Kaldor-Hicks Efficiency, dan Institutional Efficiency, penelitian ini menemukan bahwa Omnibus Law secara normatif berhasil menurunkan sebagian biaya transaksi dan mendorong iklim investasi, namun secara substantif masih menimbulkan ketimpangan distribusi manfaat, terutama terhadap pekerja dan masyarakat kecil. Dalam perspektif Hukum Profetik yang dikembangkan oleh Prof. Absori, efisiensi hukum yang sejati haruslah berkeadilan dan berkemaslahatan, yakni hukum yang tidak hanya efisien secara ekonomi, tetapi juga humanis, adil sosial, dan bermoral spiritual. Oleh karena itu, Omnibus Law perlu diarahkan pada model prophetic economic efficiency, efisiensi yang menyeimbangkan antara pasar, manusia, dan moralitas hukum.
This article analyzes the application of the Economic Analysis of Law in assessing the efficiency of the Job Creation Omnibus Law in Indonesia. The focus of this analysis is on how this deregulation policy influences the efficiency of the national economy, increases investment, and creates a balance between economic growth and social justice. Using the approach of the theories of legal efficiency, Pareto Efficiency, Kaldor-Hicks Efficiency, and Institutional Efficiency, this research found that the Omnibus Law has normatively succeeded in decreasing some transaction costs, while encouraging an investment climate. However, substantively, it still leads to a gap in benefit distribution, which especially affects workers and lower-level citizens. From the Prophetic Law perspective developed by Prof. Absori, true legal efficiency must be just and bring benefits (maslahah), i.e., a law that is not only economically efficient, but also humanist, socially just, and has spiritual morality. Therefore, the Omnibus Law needs to be directed to a prophetic economic efficiency model, i.e., efficiency that balances the market, human beings, and legal morality.</dc:description>

	<dc:description xml:lang="en-US">Tujuan penelitian ini adalah untuk menawarkan paradigma profetik siber sebagai pendekatan alternatif dalam rekonstruksi sistem pembuktian hukum pidana di era digital. Paradigma ini mengintegrasikan teknologi digital forensik dengan nilai-nilai transendental humanis dan liberalis guna menjawab keterbatasan pendekatan legal-formal dan positivistik yang dominan dalam praktik hukum pidana konvensional.
Metodologi penelitian ini menggunakan pendekatan normatif-filosofis dengan metode analisis kualitatif terhadap literatur hukum, filsafat, dan teknologi forensik digital. Data dikaji secara sistematis melalui studi pustaka terhadap sumber primer dan sekunder, termasuk jurnal ilmiah, buku akademik, dan regulasi terkait.
Temuan utama menunjukkan bahwa digital forensik dapat berfungsi sebagai fondasi epistemologis dan etis dalam pembuktian hukum pidana apabila dikawal oleh prinsip keadilan substantif, akuntabilitas, dan perlindungan hak konstitusional. Paradigma profetik siber mampu membentuk sistem pembuktian yang lebih humanis, transformatif, dan reflektif, serta mendorong pembaruan regulasi dan desain pendidikan hukum yang adaptif terhadap tantangan era siber.
Implikasi penelitian ini mencakup perlunya reformulasi regulasi pembuktian digital yang berbasis etik dan konstitusional, serta integrasi nilai profetik dalam kurikulum pendidikan hukum untuk mencetak penegak hukum yang tidak hanya kompeten secara teknis, tetapi juga berintegritas konstitusional dan berkepekaan humanis.
Kebaruan/originalitas penelitian ini terletak pada konstruksi paradigma profetik siber sebagai pendekatan integratif yang belum banyak dikembangkan dalam literatur hukum pidana digital Indonesia. Penelitian ini memberikan kontribusi teoritis dan praktis dalam membangun sistem hukum pidana yang lebih adil, bermartabat, dan relevan dengan perkembangan teknologi.
The objective of this research is to offer the cyber prophetic paradigm as an alternative approach in reconstructing the criminal law evidencing system in the digital era. This paradigm integrates digital forensic technologies with humanist and liberalist transcendental values to answer the limitations of the legal-formal and  positivistic approaches, which are currently dominant in conventional criminal law practices.
The methodology of this research is that it uses the normative-philosophical approach with the qualitative method of analysis to literary materials on law,  philosophy, and digital forensic technologies. The data is systematically analyzed using the library study method on primary and secondary data, including scientific journal articles, academic books, and related regulations.
The main findings show that digital forensics may function as an epistemological and ethical foundation in providing evidence in criminal law if guided by the principles of substantive justice and accountability, as well as the protection of constitutional rights. The cyber prophetic paradigm may form an evidencing system that is more humanist, transformative, and reflective, as well as encourage the renewal of the design of legal education and regulations that are more adaptive to challenges in the cyber era.
The implication of this research encompasses the need for a reformulaton of digital evidencing regulations based on ethics and the constitution, as well as the integration of prophetic values in the curricula of legal studies, to educate law enforcers who are not only technically competent, but also have constitutional integrity and humanist sensitivity.
The novelty/originality of this research lies in its construction of the cyber prophetic paradigm as an integrative approach that has not been much developed in the literature on digital criminal law in Indonesia. This research provides theoretical and practical contributions in developing a criminal legal system that is more just, dignified, and relevant with technological advancements.</dc:description>

	<dc:description xml:lang="en-US">Kebijakan hukum narkotika di Indonesia masih berorientasi pada paradigma legal formal yang menekankan pelarangan tanpa ruang memadai bagi penggunaan medis. Padahal dalam praktik global sejumlah negara telah membuka ruang legalisasi terbatas bagi penggunaan medis narkotika tertentu, seperti ganja untuk tujuan terapeutik. Penelitian ini bertujuan untuk menganalisis kebijakan hukum narkotika Indonesia dalam perspektif hukum transendental, dengan fokus pada upaya humanisasi regulasi melalui nilai kemanusiaan, moralitas, dan spiritualitas hukum. Dengan menggunakan pendekatan normatif filosofis dan studi kasus, penelitian ini menelaah konflik antara larangan hukum positif dan hak atas kesehatan warga negara, sebagaimana tampak dalam kasus Santi Warastuti dan perjuangan legalisasi ganja medis di Indonesia. Hasil penelitian menunjukkan bahwa kebijakan hukum narkotika di Indonesia masih terjebak dalam formalisme normatif yang mengabaikan nilai transendensi dan kemanusiaan. Oleh karena itu, perlu dilakukan rekonstruksi hukum berbasis nilai transendental yang menempatkan hukum bukan hanya sebagai alat pengendalian sosial, tetapi juga sebagai sarana pemeliharaan kehidupan dan kemaslahatan manusia.
In Indonesia, legal policies on narcotics still orient towards the formal legal paradigm emphasizing prohibition without an adequate room for medical usage. Conversely, in the global practice, several countries have opened room for the limited legalization of the medical usage of certain narcotics, such as the use of cannabis for therapeutic purposes. This research aims to analyze legal policies on narcotics in Indonesia from a transcendental law perspective, with the focus on the efforts to humanize regulations through the values of humanity, morality, and spirituality. By employing the philosophical-normative and case study approaches, this research analyzes the conflict between the prohibition of positive law and citizens’ rights to health, as shown in the case of Santi Warastuti and the effort to legalize medical cannabis in Indonesia. Research results show that the legal policies on narcotics in Indonesia are still trapped in normative formalism that neglects the values of humanity and transcendence. Therefore, there needs to be a transcendental value-based reconstruction of law that places the law not merely as an instrument of social control, but also as a facility to maintain life and bring benefit (maslahah) to humanity</dc:description>

Artikel ini mengkaji norma ought melalui analisis filosofis-komparatif antara Pure Theory of Law Hans Kelsen dan konsep taklīfī al-Ghazali dalam teori hukum Islam. Penelitian ini bertujuan untuk menelaah dasar epistemologis normativitas dengan mendialogkan dua tradisi pemikiran yang berbeda, yakni positivisme hukum modern dan yurisprudensi Islam klasik. Pendekatan filosofis dan konseptual digunakan untuk menganalisis pemahaman Kelsen tentang ought (sollen) sebagai pengandaian logiko-transendental yang menjadi dasar validitas norma hukum tanpa bergantung pada klaim moral maupun metafisik. Dalam kerangka Kelsen, normativitas muncul dari norma dasar (Grundnorm) yang dipresuposisikan secara rasional dan membentuk sistem norma yang otonom dari otoritas teologis. Selanjutnya, pembahasan diarahkan pada konsep taklīf al-Ghazali, di mana normativitas berpangkal pada خطاب الشرع (sapaan hukum ilahi) yang ditujukan kepada subjek hukum yang bermoral dan bertanggung jawab. Bagi al-Ghazali, norma ought tidak dapat dipisahkan dari wahyu dan beroperasi dalam kerangka teleologis-etik yang bertujuan mengarahkan manusia pada kesempurnaan moral dan keselamatan. Melalui dialog kritis antara kedua perspektif tersebut, penelitian ini menunjukkan bahwa meskipun keduanya sama-sama memandang ought sebagai kategori normatif non-empiris, terdapat perbedaan mendasar dalam sumber epistemologis dan asumsi ontologis yang melandasinya. Artikel ini menyimpulkan bahwa konsep taklīfī al-Ghazali menawarkan alternatif normativitas yang bersifat teologis dan berorientasi nilai terhadap model normativitas rasional-transendental yang dikemukakan oleh Kelsen.
This article analyzes the ought norm using the comparative-philosophical analysis of Hans Kelsen’s Pure Theory of Law and al-Ghazali’s taklīfī concept in the Islamic legal theory. This research aims to analyze the epistemological normativity basis by confabulating two different thought traditions, i.e., modern legal positivism and the jurisprudence of classical Islam. The philosophical and conceptual approaches are used to analyze Kelsen’s understanding of ought (sollen) as a transcendental-logical assumption that becomes the basis for legal norm validity without depending on moral and metaphysical claims. In Kelsen’s framework, normativity emerges as a fundamental norm (Grundnorm) that is rationally presupposed, forming an autonomous system of norms from the theological authority. Next, the discussion is directed to al-Ghazali’s taklīfi concept, where normativity is based on خطاب الشرع (divine legal greeting), which is directed to legal subjects with morality and responsibility. For al-Ghazali, the ought norm cannot be separated from revelation. It operates within a teleological-ethical framework, which aims to direct human beings to moral perfection and safety. Through a critical dialog between these two perspectives, this research shows that even though both view ought as a non-empirical normative category, there is a fundamental difference in the epistemological source and ontological assumption that become their bases. This article concludes that, with its theological and value-oriented characteristics, al-Ghazali’s taklīfī concept offers an alternative normativity concept to Kelsen’s rational-transcendental normativity model.

	<dc:description xml:lang="en-US">Fenomena Sukarelawan Pengatur Lalu Lintas (Supeltas) menampilkan dialektika unik antara legitimasi transendental—berbasis nilai moral dan gotong royong—dengan legitimasi hukum positif negara. Penelitian kualitatif ini menganalisis ketegangan tersebut melalui studi kasus di Kartasura, menemukan bahwa meskipun didorong oleh panggilan altruistik dan kebutuhan ekonomi, posisi Supeltas secara hukum lemah dan rentan konflik. Mereka beroperasi dalam hambatan regulasi yang memicu masalah akuntabilitas dan potensi perlindungan. Artikel ini menyimpulkan bahwa solusi berkelanjutan terletak pada pembentukan model regulasi kolaboratif yang menginstitusionalkan nilai transendental ke dalam kerangka hukum yang sah. Model yang diusulkan bertumpu pada empat pilar: legalisasi dan klasifikasi, standardisasi kewenangan, akuntabilitas dengan perlindungan hukum, serta pemberdayaan berkelanjutan. Dengan demikian, penelitian ini menawarkan jalan untuk mentransformasi Supeltas dari anomali menjadi mitra negara yang sah dalam penciptaan tata kelola lalu lintas yang lebih manusiawi dan efektif.
The phenomenon of voluntary traffic controllers (supeltas) shows a unique dialectics between transcendental legitimacy—based on morality and togetherness values—and the state’s positive law legitimacy. This qualitative research analyzes this tension through a case study in Kartasura, Central Java Province, Indonesia. It was found that even though the supeltas’ activities are pushed by altruistic calling and economic needs, their position is legally weak and vulnerable to conflicts. They operate in a regulatory void, which triggers the issue of accountability and the potential for misuse. This article concludes that a sustainable solution is placed in the formation of a collaborative regulatory model, which institutionalizes transcendental values into a valid legal framework. It is proposed that this model stands on four pillars: legalization and classification, authority standardization, accountability with legal protection, as well as sustainable empowerment. Therefore, this research offers a way to transform the supeltas from an anomaly to legitimate partners of the state in creating a more humane and effective traffic governance.</dc:description>
