Analysis of the Legal Framework of POJK 27/2024 Regarding Information Security for Crypto-Based Trading Assets

This study analyzes OJK Regulation No. 27 of 2024 on Crypto Asset Trading from an information security perspective. Using normative legal research and a conceptual approach, the analysis draws on primary legal materials, including the regulation itself, and secondary materials, such as doctrine and literature. Through library research, the study employs a legal syllogism, using basic legal concepts legal subjects, objects of rights, legal relationships, juridical facts, and rights and legal obligations as the major premise, with normative facts from the regulation and privacy characteristics in the crypto ecosystem as the minor premise. The findings indicate that the regulation lacks a comprehensive legal framework, applying a uniform regime to crypto assets with varying privacy levels, from high Confidentiality to full transparency under Know Your Customer (KYC) principles. The absence of systematic differentiation among legal subjects, objects, relationships, and rights based on characteristics such as Confidentiality, Integrity, and Non-repudiation is evident. This research contributes that the systematic evaluation model, from the perspective of Legal Systematics Review, integrates the legal framework and the principles of Information Security as a tool for analyzing the quality of Crypto Asset Trading regulation in Indonesia. The normative framework includes privacy, traceability, authentication, authorization, and non-repudiation in each crypto technology. This means that the quality of POJK is not evaluated from the aspects of trading, governance, and market supervision, but also from its suitability with the information security characteristics that are the identity of each crypto asset.
